Welcome to Sculpt AI Inc, a personalized fitness platform offering intelligent workout generation, workout logging, and food tracking. These Terms of Service ("Terms") govern your access to and use of our mobile applications, websites, and services (collectively, the "Services").
By accessing or using our Services, you agree to comply with these Terms and our Privacy Policy. If you do not agree, please do not use Sculpt AI Inc.
1. ELIGIBILITY
You must be at least 13 years old to use Sculpt AI Inc. If you are under 18, you must have parental or guardian consent. By using Sculpt AI Inc, you confirm that you meet these requirements.
2. HEALTH AND MEDICAL DISCLAIMER
Sculpt AI Inc is not a medical service. The content, features, and recommendations within the app are intended for informational purposes only.
Always consult a licensed healthcare provider before starting any new fitness, nutrition, or wellness program.
Using Sculpt AI Inc is at your own risk.
3. ACCOUNT REGISTRATION AND SECURITY
When you create an account:
- You agree to provide accurate and current information.
- You are responsible for all activity under your account.
- You must not share login credentials or impersonate others.
We reserve the right to suspend or terminate accounts that violate these Terms or create security risks.
4. SUBSCRIPTION TERMS AND PAYMENTS
We offer free and paid versions of the app. If you subscribe:
- You authorize us to charge the applicable fees.
- Subscription renewals occur automatically unless canceled at least 24 hours before the renewal date.
- You can manage subscriptions via your app store (Apple App Store or Google Play).
- No refunds are provided except where legally required.
5. USER-GENERATED CONTENT AND DATA
You may upload or input workouts, food logs, notes, and other data ("User Content"). You retain ownership of your content, but grant Sculpt AI Inc a non-exclusive, worldwide license to use, host, store, and process this content to provide and improve the Services.
You agree not to post or share content that:
- Violates intellectual property rights
- Is misleading, abusive, or illegal
- Contains personal health information of others without consent
6. SERVICE CHANGES AND AVAILABILITY
We may update, modify, or discontinue parts of our Services at any time without liability. Features available in Sculpt AI Inc are subject to change.
7. ACCEPTABLE USE POLICY
You agree not to:
- Use Sculpt AI Inc in a way that violates any laws or regulations
- Attempt to reverse-engineer or exploit the app
- Interfere with other users' experience
- Use bots or unauthorized scripts
8. INTELLECTUAL PROPERTY RIGHTS
All rights to the Sculpt AI Inc brand, content, software, and technology (excluding User Content) belong to Sculpt AI Inc. You may not reproduce, distribute, or create derivative works without written permission.
9. TERMINATION
We may suspend or permanently ban your access if you violate these Terms or misuse the Services.
You may delete your account at any time. However, some data may be retained to comply with legal obligations.
10. DISCLAIMERS
Sculpt AI Inc provides its Services "as is."
We do not warrant:
- That the app will be error-free or always available
- That workout or food recommendations will be suitable for every user
You acknowledge that your results may vary and that Sculpt AI Inc is not responsible for your fitness or nutrition outcomes.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Sculpt AI Inc is not liable for:
- Personal injury or health complications from app use
- Loss of data or user content
- Indirect, incidental, or punitive damages
- Amounts exceeding what you paid to us in the past 12 months
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the United States and the State of New York, without regard to conflict of law principles.
Any disputes will be resolved through binding arbitration in New York, NY, and you waive the right to participate in a class-action lawsuit or class-wide arbitration.
13. PRIVACY
Your use of the app is subject to our Privacy Policy, which explains how we collect, use, and protect your data in compliance with applicable data laws including the CCPA and GDPR where applicable.
